The Court of Appeal accepted Mr Altaf Hussain's appeal in a property case, rendering a favourable decision in his favour.


LONDON. [UK]. Jul 16: The Court of Appeal, situated within the Senior Courts of England and Wales, is the highest judicial body responsible for handling appeals from other courts and tribunals. It operates exclusively in two divisions: the Criminal Division and the Civil Division. Recently, the Court of Appeal accepted Mr. Altaf Hussain's appeal in a property case, rendering a favourable decision in his favour. This significant legal victory underscores the importance of the appellate process in ensuring justice.

In September 2019, the MQM-P filed a fake claim against Mr Hussain and his associates in the Business and Properties Court of the High Court of Justice of the United Kingdom over properties in London.

ICC Judge Clive Jones of the Business and Properties Court ruled in favour of MQM-P on March 13, 2023.

On behalf of Mr Hussain, an appeal was filed in the Court of Appeal of the Royal Court of Justice against this decision.

A 3-member bench comprising Lord Justice Moylan, Lord Justice Arnold and Lord Justice Nugee of the Court of Appeal heard the appeal for two days on April 23 and 24, 2024.

The Court of Appeal has on Tuesday accepted the appeal of Mr Hussain and rejecting the decision of Judge Jones of the Business and Properties Court, and the decision of the appeal of MQM founder and leader Mr Hussain and other members of the MQM Trust was granted in favour of Mr Hussain.

In its decision, the Court of Appeal has also ordered that the matter be referred back to the High Court of Justice to determine the legality or illegitimacy of the amendment made to the constitution of MQM on August 31st and September 1st, 2016.

Mr Hussain was followed by King's Counsel Barrister Richard Slad KC and senior counsel of UK legal firm CM Atif & Co Chaudhry Solicitor Mohammad Atif Advocate and his son Solicitor Salman Atif Advocate.
