Pakistani judiciary including Supreme Court are acting as a subordinate to a country’s powerful institution: Altaf Hussain

London: 29th March 2021

Mr. Altaf Hussain, Founder & leader of MQM has said that Pakistani judiciary including Supreme Court of Pakistan is not independent and they are acting as a subordinate to a country’s powerful institution.
In a statement released on twitter today, he criticised against the judicial system of Pakistan and raised some critical questions on the acts of judiciary.
Mr. Hussain questioned; is junior, higher and apex courts in Pakistan are free and work as independent judiciary?  He said that the function of courts are to take notice of, and hold accountable all those that cross the constitutionally assigned ambit of duty and when they act unconstitutionally and illegally against an individual, group of people, political parties, their leaders and members; and against provincial and federal governments and public and private institutions, they are predefined with regard to their constitutional tasks of taking to task those responsible for supra constitutional acts.
Mr. Altaf Hussain said that Military, paramilitary, federal and provincial agencies arrest people on false or true charges, enforcedly disappearing them for years or even a day and executing them extra judicially and leaving their mutilated bodes on deserted lands. Is this not a serious crime on the part of country’s courts of law that these avoid taking notice as per the law and the constitution of the courts against those who dump mutilated bodies on deserted lands?
He further said that hundreds of people from Baloch, Sindhi, Pashtun and Mohajir, who have been gone missing after country’s agencies picked them  and despite constitutional petitions pending with country’s higher and apex courts, they are still not returned or even produced in court of law. However, their mutilated bodies are found every other day. Isn't it a crime to let these unconstitutional and brutal acts go sans courts notice and legal actions? Avoiding legal actions either by lower or higher courts including Supreme Court of Pakistan against unconstitutional measures clearly manifests that these courts are absolutely hijacked and enslaved.
Mr. Altaf Hussain said that the judiciary including Supreme Court of Pakistan is acting as a subordinate institution to country’s big and authoritative corridors of power. These courts constitute a force that backs the corrupt military junta, and they validated the countless unlawful and unconstitutional actions of military junta including ISI.
