The urgent hearing petition filed in the Sindh High Court against illegal arrest and enforced disappearance of former MQM MNA Nisar Panhwar was not heard once again

The urgent hearing petition filed in the Sindh High Court against the illegal arrest and enforced disappearance of former MQM member National and Provincial Assembly Nisar Ahmad Panhwar was not heard in the court once again. It is to be remembered that Nisar Ahmad Panhwar filed a constitutional petition in the Sindh High Court on August 27, 2022, against the unconstitutional and illegal ban on the publication of the writings, speeches and pictures of Mr. Altaf Hussain, the founder and leader of MQM. The hearing of this application was to be held on August 30, but a day before the hearing, i.e. between August 30 and 29, he was arrested by Rangers and police officers from his house in Gulistan Johar. 

Against the arrest of Nisar Panhwar, his son had filed a habeas corpus petition in the Sindh High Court on August 31. The initial hearing of the petition No. 5059/22 was held on September 1, but the court issued notices to the police and administrative authorities and extended the hearing to October 13, 2022. After which an urgent hearing request was filed, which was scheduled to be heard on September 9. The case of Nisar Panhwar was on number 11 but the judge heard the applications up to serial number 10 and ended the court proceedings before hearing the application about Nisar Panhwar.

Another application for urgent hearing was filed against the enforced disappearance of Nisar Panhwar, which was scheduled to be heard on Monday, September 26. This application was on case number 6, but after hearing the applications from serial number one to 4, the court surprisingly assigned serial number 5 to 9. By postponing the hearing of the applications up to 10, the applications were heard from the 10th number. In this way, the request for an urgent hearing against keeping Nisar Panhwar in custody was not heard even on Monday.
It should be noted that 29 days have passed since the arrest and forced disappearance of Nisar Panhwar and he has not been produced in any court so far.
